Terms of Service

1. Acceptance of terms

By using the 428 Museum website, its augmented reality experiences, or the admin panel, you accept these Terms of Service. If you don’t agree, you should not use the platform.

2. Service description

428 Museum is a platform that lets museums and cultural institutions create and publish augmented reality experiences (3D models, animations and educational content) accessible via QR codes, along with an admin panel to manage those experiences.

3. Accounts and panel access

Access to the Super Admin panel is restricted to users authorized by 428 Museum or the client museum. You’re responsible for keeping your credentials confidential and for all activity carried out from your account.

4. Plans and payment

Available plans, their features and prices are described on our Pricing page. Specific billing terms for client museums are agreed individually when contracting the service.

5. Acceptable use

By using the platform, you agree not to:

• Use the service for unlawful or unauthorized purposes.
• Attempt unauthorized access to third-party accounts, data or systems.
• Interfere with the platform’s normal operation.
• Upload content that infringes third-party intellectual property rights.

6. Intellectual property

The 3D models, text, design and interface of 428 Museum are the property of 428 Museum or its licensors, except for content provided directly by each client museum (e.g. pieces from its own collection), which remains the property of that museum.

7. Service availability

We work to keep the platform available, but we don’t guarantee uninterrupted or error-free operation. We may temporarily suspend the service for maintenance or force majeure events.

8. Limitation of liability

To the extent permitted by law, 428 Museum won’t be liable for indirect, incidental or consequential damages arising from the use or inability to use the platform.

9. Termination

We may suspend or cancel a user’s or client museum’s access for breaching these terms, with prior notice when reasonably possible.

10. Governing law

These terms are governed by the laws of the Republic of Colombia, without prejudice to consumer-protection rules or other mandatory rules that may apply in your jurisdiction.
